Do you have the right to “silence” them or can neighbors make noise whenever they want?
Any owner, user or occupant in the block is obliged:
not to carry out activities or actions in its home which cause anxiety for other neighbors beyond what is usual;
to observe the rules of internal order in condominiums.
That sounds good, but your neighbor can argue that his personal right is to make noise and repair his home.
When is it forbidden to make noise? Who sets the rules?
Important! The playing of musical instruments and singing for training, rehearsing, teaching and music can be done only from 08.00 to 14.00 and from 16.00 to 22.00. After that, it is forbidden to make any kind of noise. You have all the right to ask other neighbors if they are bothered by the same problem and talk to the “problematic” neighbor first. If they still refuse to respect you, you should immediately talk to the authorities and let them handle the problem.
The General Meeting of Condominiums is obliged to adopt Rules for the internal order of the condominium. The decision is taken by a majority of more than 50% of the represented shares of the common parts of the condominium. According to the law, the Minister of Regional Development and Public Works adopts an exemplary internal regulation that can be used by the General Assembly and is not obligatory.
With the current exemplary rules, it means that you have the right to “silence” your neighbors. But you should know that it is forbidden to dance, sing, to talk and to use sound systems, to wash and use dishwashing machines, to perform productive activities and repair works that disturb the rest of the inhabitants from 22:00 to 8:00am and 14 to 16 o’clock in the afternoon. Exceptions are allowed only with the permission of the Chairman of the Board. It is true that they have the right to make noise, but only until 22:00. So, if they are still making noise after that period of time, it means that they are breaking the law and you have all the right the call the police and “silence” them so you can sleep peacefully.
